Welcome to OpenCampground.com! These Terms and Conditions (the "Terms") govern your use of the OpenCampground.com website (the "Site") and the OpenCampground.com software (the "Software"). By using the Site or Software, you agree to be bound by these Terms.
OpenCampground.com grants you a limited, non-exclusive, non-transferable license to use the Site and Software for your own personal or business purposes. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content, software, or other materials obtained from the Site or Software.
You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. You agree to:
You are solely responsible for all Content that you upload, post, or otherwise make available on the Site or through the Software. You represent and warrant that you own all of the Intellectual Property Rights in your Content or that you have the necessary licenses, permissions, and consents to use and distribute your Content.
OpenCampground.com does not guarantee the accuracy, completeness, or quality of any Content. OpenCampground.com reserves the right to remove any Content from the Site or Software at any time, for any reason, without notice.
OpenCampground partners with AvantLink, a third-party affiliate network, to display sponsored advertisements and product recommendations throughout our service. By using our service, you acknowledge and agree to the following terms regarding affiliate marketing:
OpenCampground.com provides its core platform services at no cost to users. For credit/debit card transactions, payment processing fees apply. Users may elect to pass these processing fees on to Guests. The fee structure is determined by OpenCampground.com and may be adjusted periodically with notice to users.
All reservations made or accepted with a credit and debit card transactions must be processed through OpenCampground.com's designated payment processor. Users may accept cash, personal checks, and business checks for payments. Money orders are not accepted. This policy applies to both online and in-office transactions.
OpenCampground applies a System Fee to reservations processed through our platform. The fee structure varies based on payment method, processing choice, and annual reservation volume. Tiered rates are available based on total reservation volume. For customers using our integrated payment processing, the System Fee applies only to cash and check reservations. For customers using external payment processors, the System Fee applies to all reservations.
One System Fee is applied per reservation at the time of creation, regardless of the reservation's length of stay. Moving a reservation to a different site without substantially changing dates (within 2 days) will not incur an additional System Fee. Minor adjustments to arrival or departure dates (up to 3 days) will not incur an additional fee. Extending a stay by more than 7 days beyond the original departure date or changing both arrival and departure dates by more than 3 days will be considered a new reservation and will incur an additional System Fee.
The System Fee applies to all reservations at the time of creation. For reservations cancelled within 24 hours of creation, the System Fee will not be applied. For all cancellations made after 24 hours, the System Fee will remain in effect. This fee compensates for the reservation processing service, which has already been performed.
System Fees are calculated at the end of each month and invoiced monthly with payment due within 15 days. Customers can pay with a credit card or bank account. Customers with a payment method on file will be charged automatically. Failure to pay System Fees when due may result in service interruption or termination.
OpenCampground monitors reservation patterns to identify potential fee avoidance strategies. Additional fees may be applied if systematic fee avoidance is detected, including but not limited to: creating single reservations and repeatedly extending them in small increments, frequently canceling and rebooking reservations with minor changes, or using long-term stays to obscure multiple distinct reservations.
OpenCampground reserves the right to modify the System Fee structure with thirty (30) days' notice to customers. Notice of fee modifications will be provided via email to the customer's registered email address. Continued use of the OpenCampground platform after the effective date of any fee modification constitutes acceptance of the new fee structure.
Customers may, at their sole discretion and in compliance with applicable laws, implement their own booking fees or service charges to offset OpenCampground system fees. OpenCampground makes no representations regarding the legality or advisability of customer-implemented fees in any jurisdiction. Customers are solely responsible for ensuring that any fees they implement comply with all applicable laws and regulations.
For the purposes of these Terms, a “Site” is defined as any individual, rentable unit managed through the OpenCampground platform. This includes, but is not limited to:
Customers are billed $2.50 per site that is entered into the OpenCampground platform.
A minimum monthly charge of $50 applies to all accounts. If the total per-site charges in a given month are less than $50, the account will be billed $50.
Fees are calculated and invoiced on a monthly basis. The amount due each month will be the greater of (a) the total per-site charges, or (b) the $50 minimum monthly fee.
For customers that are on a subscription plan, subscriptions to the OpenCampground platform must be paid electronically using a valid credit card, debit card, or bank account. We do not accept cash, personal checks, business checks, or money orders as payment methods. OpenCampground does not set up or auto-bill any recurring payments unless a customer has provided explicit email authorization. Customers are responsible for managing their own subscription renewals.
If OpenCampground receives a subscription payment in an unacceptable form such as cash or check, the payment will be voided, and either a copy of the voided payment will be emailed to the customer or sent via postal mail. Failure to pay subscription fees within 30 days of the invoice date may result in disconnection or removal of access to the OpenCampground platform.
If any invoice remains unpaid beyond 90 days from the due date, we reserve the right to:
You will be responsible for all costs associated with collection efforts, including but not limited to collection agency fees, attorney fees, and court costs, to the extent permitted by law.
We will provide written notice before referring any account to a collection agency or credit reporting agency, giving you a final opportunity to resolve the outstanding balance.
We use third-party payment processors to facilitate transactions on our platform. By using our services, you agree to be bound by the terms and conditions of these third-party payment processors. You acknowledge that we may share your personal and financial information with our third-party payment processors as necessary to complete transactions and manage your account.
Use of our designated payment processor is mandatory for all credit and debit card transactions. By using our services, you agree to:
Accounts are intended for active OpenCampground customers only. Seasonal customers may retain access during their off-season; however, extended inactivity outside of seasonal use may result in account suspension or deactivation. Customers who migrate to another reservation system or otherwise discontinue service with OpenCampground are not permitted to retain active access to the platform.
Using OpenCampground to manage reservations or guest data during the billing period constitutes active use. Active use includes, but is not limited to:
Even minimal platform interaction during a billing period qualifies as active use. Continued use of the platform means agreeing to applicable fees for that billing period. Unpaid invoices may result in account suspension, loss of access to data, or further collection action.
Note: Simply having an account without logging in or interacting with the platform does not constitute active use. However, any engagement with reservations, guest data, or management features will trigger billing for the applicable period.

OpenCampground.com strives to maintain 99.9% uptime for the Service. In the event of any unscheduled downtime, we will make reasonable efforts to restore the Service as quickly as possible.
We may perform scheduled maintenance or updates to the Service. We will provide advance notice of any scheduled maintenance that may result in Service interruption. By using the Service, you agree to receive automatic updates as they become available.
We perform regular backups of all user data. However, you are encouraged to maintain your own backups of any critical data. In the event of data loss, we will make reasonable efforts to recover your data from our most recent backup.
Users are expressly prohibited from storing, entering, or transmitting any credit card numbers, debit card numbers, or other payment card information in any field or area of the Service not specifically designated for payment processing. This includes special notes fields, memo lines, internal notes sections, comment fields, customer information fields, order notes, description fields, or any other free-text or data entry field not explicitly designated for payment processing.
This restriction is implemented to protect customer financial information, maintain compliance with Payment Card Industry Data Security Standards (PCI DSS), prevent unauthorized access to sensitive financial data, and ensure the security and proper handling of payment information.
We provide customer support via email and our help center during our normal business hours. We aim to respond to all support requests within 24 hours. Support is limited to issues directly related to the use of our Service. We do not provide support for third-party integrations or custom modifications to our Service.
OpenCampground.com may terminate your access to the Site or Software at any time, for any reason, without notice. You may also terminate your use of the Site or Software at any time.
The Site and Software are provided "as is" and "as available." OpenCampground.com expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall OpenCampground.com be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, even if OpenCampground.com has been advised of the possibility of such damages.
Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in your jurisdiction. The decision of the arbitrator will be final and binding on both parties.
These Terms will be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions.
All notices and other communications under these Terms will be in writing and will be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed to info@opencampground.com.
We reserve the right to modify these Terms at any time. We will notify users of any significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
